What Is Personal Information

“Personal Information” means the same as it does in the Privacy Act 1993. In general terms, this includes any information that can be used to personally identify you. This may include (but is not limited to) your name, age, gender, address, contact details (including phone numbers and email addresses) and possibly financial information, including your payment information. If the information we collect personally identifies you, or you are reasonably identifiable from it, then the information is considered personal information.

Why Do We Collect Personal Information?

We collect and use your personal information to provide, administer, improve and personalise your experience with Horokea House Limited and our products and services, to run competitions, conduct surveys, process payments and refunds, maintain and update our records, or verify your identity.  We may not be able to do these things without your personal information, such as deliver your online orders or respond to your enquiries.

We do not sell or rent your information to third parties, however we do use other companies and individuals to assist us with payment, point of sale, marketing, data processing, IT, archival, auditing, accounting, customer contact, legal, business consulting, banking, delivery, data analysis, document management, research, investigation, insurance, website and other services. These companies are not authorised to use your personal information for any other purposes.

What Happens If We Are Not Able To Collect Personal Information?

If you choose not to provide us with the personal information described within this policy, then;

  • We may not be able to provide you with the product or services you have requested, either to the same standard or at all
  • We may not be able to provide you with information about products or services that you may want, including information about discounts, sales or special promotions; we may not be able to tailor our content, website and communications for your preferences.

How Do We Disclose Personal Information?

We may disclose your personal information to our employees, for the operation of our websites or our business, and for the specific purpose of fulfilling requests by you, and to provide products and services to you, and where we are permitted to under the Privacy Act.

Where Horoeka House Limited utilises third parties to undertake services, we may provide those third parties with some of your information if it is required to fulfil those services and only to the extent required to fulfil those services. Examples of such third party providers may include:

  • Service providers such as web hosting providers, IT systems administrators, mailing houses, couriers, payment processors, photographic analysers, data entry service providers, electronic network administrators, debt collectors, and professional advisers such as accountants, solicitors, business advisors and consultants
  • Software providers such as customer relationship management, and accounting software
  • Existing or potential suppliers, business partners or joint venture entities or partners
  • Sponsors, or promoters of any competition that we conduct or promote via our services
  • Specific third parties authorised by you to receive information held by us

We require any third party to protect your information against unauthorised use or disclosure.

Some of these service providers may be located overseas. We take reasonable steps to ensure that the overseas recipients of your personal information do not breach the privacy obligations relating to your personal information.

We do not provide your personal information to other organisations for the purposes of direct marketing unless expressly authorised by you.

Beyond the above, we release personal information only when it is permitted under the Privacy Act or required by law for legal compliance and law enforcement (including to government agencies with statutory law enforcement responsibilities, and/or to your Internet Service Provider or network administrator); to facilitate court proceedings; enforce or apply our terms and conditions; or protect the rights, property, or safety of Horoeka House Limited, our users, or others, and where we reasonably believe that disclosure is necessary. Government agencies with statutory roles enabling them to request data from us include but are not restricted to the Police, Inland Revenue and the Ministry of Business, Innovation and Employment.

Online Security

Horoeka House Ltd utilises a variety of security measures to maintain the safety of your personal information.  All user contact information is contained behind a firewall and only accessible by a limited number of employees who have special access rights.  As an added safeguard, Horoeka House does not gather or store credit card information.

We take website security extremely seriously and always endeavour to provide a secure, safe platform from which to conduct online transactions.  We use the industry standard Secure Sockets Layer (SSL) protocol, which encrypts information as it is transmitted over the internet.  This encryption scrambles details such as personal information so that other computers are unable to decipher the information, ensuring privacy and security.

However, please note that whilst we take appropriate technical and organisational measures to safeguard the personal data that you provide to us, no transmission over the Internet can ever be guaranteed secure.  Consequently, please note that we cannot guarantee the security of any personal data that you transfer over the internet to us.

If you are using a computer or terminal in a public location, we recommend that you always log out and close the website browser when you complete an online session for your security.  In addition, we recommend that you take the following security measures to enhance your online safety:

  1. Keep your account passwords private.  Remember, anybody who knows your password may access your account
  2. When creating a password, use at least 8 characters.  A combination of letters and numbers is best.  We also recommend that you frequently change your password.  You can do this by going to ‘My Account’ and clicking ‘Change your password’

Personal Information Access 

We will take all reasonable steps to ensure that personal information held by us is accurate and up-to-date. You are entitled to obtain from us confirmation as to whether or not we hold personal information about you and you are entitled to reasonable access to this information. You may also request:

How Do We Use Cookies?

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

How Long Do We Retain Your Data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

How Can You Complain About A Breach Of Privacy?

If you believe your privacy has been breached by us or have any questions or concerns about our Privacy Policy please, contact us using the contact information below and provide details of the incident so that we can investigate it. We have a formal procedure for investigating and dealing with complaints. Once the Privacy Investigator receives a complaint in writing the Privacy Investigator will commence an investigation with the relevant business unit from which the alleged breach stemmed. The investigator will endeavour to determine the nature of the breach and how it occurred.

We may contact you during the process to seek any further clarification if necessary. If a breach is found, the Privacy Officer will escalate the matter to management so that the process can be rectified to prevent any further breaches from taking place. We will also contact you to inform you of the outcome of the investigation. We will endeavour to resolve all investigations within a reasonable time.
